The FDA has battled with how to handle e-cigarettes for years. Juul Labs, perhaps the most visible brand of e-cigarettes, has been the target of hundreds of lawsuits claiming the company marketed to teenagers who were too young to consume their products. According to a recent USA Today article, the FDA is preparing an order to remove Juul products from the American market.

The decision comes after a two-year review of the company’s application for authorization to continue selling products that are not fruit-flavored. Although underage vaping rates spiked over the past 10 years, recent surveys have shown that the numbers are finally declining. The National Youth Tobacco Survey showed a decline from 19.6% of high school students vaping in 2020 to 11% in 2021.
